Terms of Service

01The agreement

These Terms are an agreement between Color Cloud Software Private Limited ("Color Cloud", "we") and the business or person who creates a C2qor account ("you"). By creating an account, accepting an invitation, or using C2qor, you agree to these Terms and to our Privacy Policy. If you accept on behalf of a business, you confirm you are authorised to bind it.

02The service

C2qor lets you connect messaging channels (WhatsApp, Telegram, Instagram, Facebook Messenger, email and SMS) and manage customer conversations, contacts, deals, bookings, campaigns, bots, automations and AI-assisted replies. We may improve or change features over time; we will give reasonable notice before removing a feature you depend on.

03Your account

• You must be at least 18 and give accurate sign-up information.
• Keep your password private and turn on two-factor sign-in for owner and admin users. You are responsible for activity under your account and your team members' accounts.
• Tell us promptly at support@colorcloudindia.com if you suspect unauthorised access.

04Acceptable use

You agree not to use C2qor to:

• Message people who have not agreed to hear from you, or keep messaging someone who opted out.
• Send spam, phishing, malware, or unlawful, misleading, hateful or abusive content.
• Break the rules of the channels you connect, including the WhatsApp Business, Meta Platform, Telegram and TRAI commercial communication (DLT) rules.
• Collect or process personal data without a lawful basis under the DPDP Act, 2023.
• Attempt to access another business's data, probe or overload the service, or get around its limits or security.

We may suspend sending or an account that breaks these rules or puts other customers, a channel connection or the service at risk, and will tell you why unless the law prevents it.

05Your data

You own the data you and your customers put into C2qor. You give us permission to store and process it only to provide the service, as described in the Privacy Policy, where we act as your Data Processor for your customers' data. You are responsible for having the consent or other lawful basis needed to message your customers and to store their data. You can export your data at any time from Settings.

06Third-party services

Channels and AI providers you connect (such as Meta, Telegram, SMS gateways, OpenAI, Anthropic or Groq) are provided by those companies under their own terms and charges. We are not responsible for their availability, pricing, policy changes or decisions, such as a template rejection or a number being restricted.

07Plans and fees

Paid plans, if you choose one, are billed in advance at the price shown when you subscribe, plus applicable GST. Channel and AI provider charges are billed by those providers. Fees are non-refundable except where the law requires otherwise. We will give at least 30 days' notice of a price change.

08Availability and support

We work to keep C2qor available and back it up regularly, but the service is provided "as is" without a guaranteed uptime unless a separate written agreement says otherwise. Support is available at support@colorcloudindia.com.

09Liability

To the extent the law allows, Color Cloud is not liable for indirect or consequential losses, such as lost profits or lost business, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under Indian law.

10Ending the agreement

You can stop using C2qor and delete your account at any time from Settings (see Data deletion). We may end these Terms with 30 days' notice, or immediately for a serious breach. Once an account is deleted, its data is removed as the Privacy Policy describes, so export anything you need first.

11Governing law

These Terms are governed by the laws of India. Courts in Bengaluru, Karnataka have exclusive jurisdiction, subject to any consumer rights you cannot waive.

12Changes to these Terms

We may update these Terms. We will email account owners at least 15 days before a material change takes effect; continuing to use C2qor after that means you accept the new Terms.
